Exceptional Hardship

Are you pleading guilty, or worried about being convicted of a motoring offence that carries penalty points?

This is a potentially devastating situation. If you already have 9 points on your licence then the Court must impose a minimum mandatory period of six months disqualification, unless it can be satisfied on the balance of probabilities that exceptional hardship would be caused. If you or those around you would be affected particularly detrimentally, then the expert team at Just Motor Law can help to save your driving licence.

Unlike, the Special Reasons argument, an Exceptional Hardship argument does not apply to the circumstances of the offence but on your overall circumstances and the impact the conviction and potential disqualification could have on you and those around you. This argument takes into account the fact that the potential punishment does not fit the crime. The Court can consider the hardship that will apply to both you and others (such as employees if you were to lose your business, your family or relatives you help care for etc).

As experts in this field we understand the types of situations that can lead to a successful Exceptional Hardship argument. We will discuss your case and all of the circumstances with you in detail and advise you when this is an argument that can be put forward on your behalf in an aim to SAVE YOUR DRIVING LICENCE.

It is important that all appropriate evidence in support of this argument is put before the Court.  We recommend you contact us as soon as possible so that we can advise you on what is required. Our team of experts will advise you what information is required in advance of the hearing date.

The onus is upon you to establish that Exceptional Hardship would be caused and we will attend court with you and present the most forceful representations on your behalf. We will present the complex case law where appropriate that deals with what the Court may take into account.

Remember, there is always something that we can do to help and with Just Motor Law you will not face this stressful and complex situation alone.
