How does the appeal process work?
If you have been convicted in the Magistrates Court, then your case would be heard at the Crown Court on appeal. You have an automatic right to appeal your conviction and/or sentence within 21 days of the date you were found guilty in the Magistrates Court.
In appealing, your case would be heard again by an experienced Crown Court Judge as well as two Magistrates. This trial will be very different to the trial in the Magistrates Court when the Court was just made up of local volunteer Magistrates with no legal qualifications!
The prospects of getting your conviction overturned will be increased by having expert representation at the appeal hearing. Just Motor Law's Matt Reynolds is a solicitor advocate, and can personally represent you in the Crown Court, unlike many other solicitors who only represent their client’s in the Magistrates Court. We also work very closely with expert motoring barristers who can also represent you at appeal hearings.
Another avenue to have your case re-heard is when you are convicted by the Magistrates Court in your absence and where you had no knowledge of this. This route is not an appeal as such but an application to the Magistrates Court to have your case re-opened and re-heard in that court.
