Special Reasons

Are you pleading guilty, or worried about being convicted of a motoring offence?

This is a potentially disastrous situation. If you already have 9 points on your licence then the Court is going to ban you from driving for a minimum of 6 months (totting up). If the offence carries mandatory disqualification, then the Court is going to ban you from driving for a minimum of 12 months!

The law says that if a Special Reason can be found then the Court may either not endorse the penalty points on your licence, choose to disqualify you for a shorter period or exercise their discretion not to ban you from driving at all.

The law defines that a Special Reason must:

a) be a mitigating or extenuating circumstance;
b) not amount in law to a defence to the charge;
c) be directly connected to the commission of the offence; and
d) be one which the Court ought properly to take into consideration when imposing sentence.

This argument can apply to a wide variety of motoring offences such as drink driving, driving without insurance, speeding, failing to comply with traffic signs, dangerous and careless driving etc.
